HMRC launch NMW compliance scheme

Care providers facing a complaint of not paying the NMW to care workers providing sleep-in services, have been offered an olive branch by HMRC to enable them to calculate the back-pay owed (if any). The scheme launched on 1 November is intended to support providers meet their legal requirements, whilst also minimising service interruption. Potentially, the sleep-in crisis could bring down social care with Mencap estimating a £400 million black hole in care provider finances. Government continues to discuss the issue with care providers and has also opened discussion with the EU about whether potential funding would breach State Aid rules; State Aid is public funding which unfairly supports parts of the commercial market to the detriment of others.

It does not look like a national solution is imminent any time soon.
